Gramm-Leach-Bliley Act: The
Safeguards Rule
The Gramm-Leach-Bliley Safeguard Rule requires financial institutions to
have a security plan to protect the confidential integrity of personal
consumer and customer information.
1.1.1 Scope
The Standards for Safeguarding Customer Information or the Safeguards
Rule is intended to protect the security and confidentiality of customer
records and information and to protect against unauthorized access to or use
of financial records or information.
1.1.2 Responsibilities
Specifically, 16 CFR 314.4 (b) of the final rule requires financial
institutions, and others managing consumer financial information, to
"Identify reasonably foreseeable internal and external risks to the
security, confidentiality, and integrity of customer information that could
result in the unauthorized disclosure, misuse, alteration, destruction or
other compromise of such information, and assess the sufficiency of any
safeguards in place to control these risks." The act recognizes that the
proper disposal of information containing consumer information is central to
preventing identity theft and other crimes.
1.1.3 Terms of reference
A term defined in the Bank Holding Company Act of 1956 as an institution
that is significantly engaged in financial activities…". (12 U.S.C.
1843(k)). This includes

Preparers of income tax returns
-
Consumer credit reporting
agencies and credit counseling services
-
Real estate transaction
settlement services
-
Debt collection agencies
In addition to the direct
providers of those services, any organization that receives data from those
providers must also comply with Gramm-Leach-Bliley requirements
